Bu çalışmanın konusunu Birleşmiş Milletler Engellilerin Haklarına
İlişkin Sözleşme’nin (EHİS) kendine özgü yaklaşımı çerçevesinde bilgi
edinme hakkını incelemek oluşturmaktadır. EHİS, 21. yüzyılın ilk
uluslararası insan hakları sözleşmesi olmak bakımından kendinden önceki
insan hakları düşüncesinin mirasını Sözleşme yapım aşamasına ve Sözleşme
metnine taşımayı başarmıştır. Buna göre engelli bireylerin bilgi edinme
hakkı, günümüz bilgi toplumlarında bilgiye erişim bağlamında
değerlendirilmektedir. Bilgiye erişim ise EHİS’te erişilebilirlik ve adalete
erişim kavramları ile birlikte ele alınan temel bir hak olarak karşımıza
çıkmaktadır. Dolayısıyla EHİS’in insan haklarına yönelik güncel
yaklaşımına göre mevcut insan hakları kategorilerinin yeniden ele
alınmasına ihtiyaç vardır. Bu çalışmanın amacı da bilgi edinme hakkı
özelinde, ayrımcılığa karşı bilgiye erişimde pratik ve kolaylaştırıcı
olanakların engelli bireylere sağlanması yönündeki insan hakları temelli
bakış açısına katkı sunmaktır.
The subject of this study is to analyze the right to information within in
the framework of the United Nations Convention on the Rights of Persons with Disabilities (CRPD)’s unique approach to human rights. As being the
first international human rights treaty of the 21st century, the CRPD has
succeeded in transfering the legacy of the existing human rights notion to
the legislation of the Convention and to the text itself. Accordingly the right
to information of persons with disabilities is addressed as part of the access
to information in current information societies. The access to information is
also recognized as a fundamental right in the CRPD which is interpreted
within the concepts of accessibility and access to justice. Therefore existing
human rights categories should be reexamined through the actual
perspective of the Convention. The purpose of this study is to contribute to
the rights based approach of persons with disabilities against
discrimination which aims to provide practical and easy to use resources
for access to information with a special focus on the right to information.
